TENNESSEE BILL WOULD REQUIRE DATA COLLECTION ON GENDER TRANSITION PROCEDURES

A proposed bill being considered by the Tennessee General Assembly would call for the state’s health department to collect information on gender transition procedures, which would be compiled in a publicly available report.

The bill’s sponsor, State Senator Brent Taylor (R-Memphis), said the data collected would be HIPAA-compliant, so it would not have identifying information, but it would include details like a patient’s age and the county they live in.

If passed, the law would also require health care and insurance providers that offer gender transition procedures to also offer detransition procedures.

The data collected by the state would also include statistics such as: name and contact information of the health care professional, drugs or surgical intervention provided, and a list of any diagnoses the person has received for a neurological, behavioral, or mental health condition.

If the bill passes, a health care professional would be suspended for six months and required to pay a civil fine of up to $150,000 if they do not comply.

The bill is set to be heard again by lawmakers on Thursday, March 26, 2026.
