CLEVELAND MAN ARRESTED AFTER USING PEPPER SPRAY TO FORCIBLY EVICT TENANT

As reported by the Cleveland Banner, on Tuesday, a 73-year-old Cleveland man, Randall Jarrett, was arrested by the Cleveland Police Department and charged with domestic assault after allegedly using pepper and bug spray in an attempt to evict a tenant from his residence forcibly.

The tenant, who had been renting a room at Jarrett’s home for about three months, reported that he sprayed pepper spray throughout the house and on her in an effort to make her leave. Although she experienced throat irritation from the spray, she had no visible eye or skin irritation and provided police with a video allegedly showing Jarrett using the pepper spray inside the residence.

Jarrett, who was wearing goggles, a bandana, and a construction mask, admitted to spraying pepper spray on the floor but denied targeting anyone directly or receiving rent from the tenant, insisting he had been trying to get her to move out for weeks. After being informed of the proper eviction process, Jarrett was taken to Bradley County Jail, where he is being held without bond.

Legal Aid of East Tennessee notes that tenants are entitled to a court hearing before an eviction can occur.
