On Friday last week, Officer Brendel was traveling eastbound down Peavine Rd. when he noticed a white Dodge Ram pickup bounce off of the double yellow line and then bounce off of the white dotted line on the opposite side of its lane. The officer approached the vehicle from behind to run its license plate, and it began to decelerate below the speed limit to approximately 23 mph as it was passing to the 30 mph zone from the 45 mph zone.

The vehicle then suddenly slammed on its brakes with no clear reason as to why, other than attempting to brake-check the officer’s
cruiser. Brendel then also braked and initiated a traffic stop on the vehicle at approximately 8:46 p.m. using his cruiser’s lights. The vehicle then pulled to the shoulder of Peavine Rd. in front of the Lakeshore Terrace condominiums.

Brendel approached the driver, Kory Krivda, and asked him why he had brake checked me, and he stated, “You were pretty much on my ***.” The officer noticed his speech appeared to be slurred, and there was the odor of alcoholic beverages emanating from his vehicle. He was asked if he had anything to drink, and he stated that he had not.

Cumberland County dispatch returned his license suspended with an exception in the course of employment. Officer Vantrump then arrived on the scene and was asked to speak to Krivda and confirm the odor of alcohol, which he did. Krivda agreed to sobriety tests but performed poorly.

Krivda was placed under arrest for driving under the influence and transported to Cumberland County
jail.

He was charged with DUI and driving on a suspended/revoked license.
