On December 5th, Crossville police units were dispatched to Tobacco Mart in response to a theft. Officer Shade Foster arrived and spoke with a store representative who said that a Hispanic male ran into the store, grabbed a tub of approximately 20 CBD gummies off of the lottery ticket case, and then ran out of the building.

The man was wearing all black and a surgical mask over his face, and security cameras caught the entire incident on film.

The store representative said he was familiar with the man who stole the gummies and said he had stolen merchandise before this incident. In the security video, he was with another Hispanic male.

Officer Foster went to the address of the second male, and made contact with him and his girlfriend. The two identified the man who stole the merchandise as Luis Funez Ovalle.

Officer Foster would return to the address, and the resident would point Ovalle out to the officer, who is still wearing the inside-out black sweatpants from the security camera footage.

Ovalle was placed into custody and placed into the back of the patrol car. A translator was called to read Ovalle his Miranda rights. He was transported to the Cumberland County Justice Center for booking and charged with theft of merchandise.

The tub of CBD gummies was unable to be recovered.
