ROANE COUNTY ATTORNEY TO FILE SUIT REGARDING OVERHANGING TREES

During the Roane County Commission meeting on Monday night, commissioners discussed for around 25 minutes whether or not to allow county attorney Greg Leffew to file a lawsuit representing the county regarding trees that are overhanging a road on Broken Arrow Point Drive which runs off of Laurel Bluff Road in South Roane County.

Road superintendent Dennis Ferguson mentioned that the trees are presenting a hazard to motorists and could fall at any time and that’s the reason they are asking the landowner to trim back the trees. If he refuses to do so, he could be cited in court, according to the statements at the county commission meeting Monday night.

The commission voted 12 to 3 to go ahead and allow the county attorney to begin the process of getting it into chancery Court so that a judge could rule on this matter.

The county cannot go on private property and trim trees or cut them down and thus is the reason the lawsuit will be filed if the landowner loses the case if it is presented. The county then can go and trim the trees and charge the landowner for the work done.
