THREE PROPOSED BILLS REGARDING MARIJUANA TO BE CONSIDERED BY TN LEGISLATURE
Three bills regarding marijuana legalization in Tennessee will be considered this week by committees.
Senate Bill 2440, or “Pot for Potholes”, was proposed last year and failed at this exact stage. The bill would legalize marijuana for people 21 and older and charge a 15% excise tax to fund state and local road and bridge repairs in Tennessee. It is set to go before the Senate Judiciary Committee today (March 23, 2026).
Senate Bill 2097 would require the secretary of state to direct each county election commission to place a ballot question on the ballot for the November general election asking voters whether the state should legalize the sale, possession, and use of medical cannabis. It is scheduled to go before the Senate State and Local Government Committee tomorrow (March 24, 2026).
Senate Bill 0960 would require county election commissions to include three non-binding questions related to the legalization of marijuana on the November 2026 ballot. The bill differs from State Bill 2097 in two ways. First, it would place three questions on the ballot rather than one. Second, the questions would be non-binding and advisory, meaning the results would not require any action by the legislature. Under this bill, the secretary of state would compile the results of the non-binding advisory referendum, publish the results on the secretary of state’s website, and forward the results to members of the General Assembly. It is scheduled to go before the Senate State and Local Government Committee tomorrow (March 24, 2026).
