On Monday, at around 1:45 p.m. Officer Samantha Seay responded to 127 North at Executive Drive in regards to a motor vehicle accident involving a semi-truck that had tipped over. Officer Seay identified the driver as Daniel Luke Brock, who was still in the vehicle.

The officer observed Brock toss his brown backpack out of the vehicle for a civilian to catch and then climb out of the vehicle on his own. While observing, the officer observed a strong odor of marijuana emanating from the cab of the truck.

She also noticed that Brock’s pupils were pinpointed and asked him when he last smoked marijuana, however, he responded that he doesn’t smoke marijuana. He even said that he didn’t know why the cab of the vehicle smelled like marijuana but did consent to a search where nothing illegal was found on him.

He refused to perform field sobriety tests, however, and became nervous and refused when asked for consent to search his backpack.

After using probable cause, the officer was able to search the bag and found 2.4 grams in a Springfield, Ohio Marijuana dispensary container, 1.32 grams of marijuana in a joint, and .42 grams of marijuana in a grinder, totaling 4.14 grams.

Brock was placed into handcuffs and transported to the Cumberland County jail and a search warrant was obtained for Brock’s blood due to suspicion of DUI. Brock was charged with driving under the influence, possession of marijuana, and possession of paraphernalia.
