CITY OF MONTEREY FACES LAWSUIT FOR SEWAGE POLLUTION
The environmental group known as Tennessee Riverkeeper has issued a press release announcing plans to sue the town of Monterey, accusing the Monterey Sewage Treatment plant of sewage pollution and violating the Clean Water Act and the Tennessee Water Quality Control Act.
According to the notice of intent to sue, the violated laws require that “no facility shall discharge pollutants to the Waters of the United States or Waters of the state, except as authorized by a permit issued pursuant to the national pollutant discharge elimination system.”
They claim that Monterey violated sections 301 and 402 of the clean water act and sections 122.1 of title 40 of the code of federal regulations. They allege the city went over discharge limitations, failed to prevent overflows and failed to document that information in overflow reports. The notice of intent to sue lists 145 of these violations.
They intend to file this lawsuit in 60 days.
