CUMBERLAND COMMISSION APPROVES CHANGES TO BEER CODE
The Cumberland County Commission voted unanimously last night to approve a resolution that will augment the county’s codes pertaining to the sale of beer close to places of public gathering.
The new resolution has come about because over the years the Cumberland County beer board has granted permits at distances less than 2,000 feet, shorter than the previous version of the code requires. Therefore case law requires that a new resolution be entered establishing a new distance requirement.
The new resolution States:
- No beer will be sold, distributed, manufactured, or stored by a business at a location inside Cumberland County within 250 ft of a school, church, or other place of public gathering.
- No beer will be sold, distributed, manufactured, or store by a business at a location inside Cumberland County up to 2,000 ft from a school, church, or other place of public gathering after due public notice has been given and clear and convincing evidence has been brought forth showing that said sale, distribution, manufacturing, or storage of said beer will interfere with a school, church, or other place of public gathering, or otherwise interfere with public health, safety, and morals.
