DUI ON PEAVINE
ACCORDING TO A REPORT FROM THE CUMBERLAND COUNTY SHERIFF’S OFFICE: On Monday last week at around 9:24 p.m., Cumberland County dispatch said intoxicated people were leaving Weigel’s on Peavine Road.
The parties, two Hispanic men, had been refused the opportunity to purchase beer due to their level of intoxication, and the clerk at Weigel’s told dispatch they were driving a black Dodge Ram and traveling west on Peavine.
Officer Tracie Burgess made contact with the driver of the truck, Oscar Juarez who had physical control of the vehicle with the keys still in the ignition. The officer observed two open Modelo beer cans in the center console.
Juarez himself had glossy, bloodshot eyes and an odor of alcohol coming off of him. He was asked to exit the vehicle, and upon doing so, he was unsteady on his feet.
Due to a language barrier, standardized field sobriety tests were not administered, and Juarez was also found to be unlicensed.
He was taken into custody for driving under the influence, violation of the open container law, and driving without a license.
While dealing with Juarez, another Hispanic Man by the name of Wenceslao Juarez approached, who was also intoxicated. His level of intoxication also led to him being taken into custody.
Both men were taken to the Cumberland County Justice Center, and a warrant was applied for and granted for a blood draw to determine Oscar Juarez’s level of intoxication.
Oscar Juarez would be charged with DUI, no driver’s license, and open container. Wenceslao was charged with public intoxication.
