DUI ON PENFIELD AND GENESIS
On Friday last week at approximately 11:25 p.m., Officer Jacob Ogle observed a Blue Chevy swerving onto the sidewalk at Penfield Street and Genesis Road. The driver maneuvered the vehicle back onto the roadway. Ogle conducted a traffic stop on Kevin Saltkill for the suspicion that he was under the influence at Crossville Church of Christ.
He made contact with Saltkill and immediately noticed that he was heavily slurring his words. Saltkill was asked if he had anything to drink, and he admitted to drinking alcohol. The officer also noticed a strong odor of alcohol emanating from the vehicle. Ogle asked Saltkill if he would be willing to blow into a portable breath tester to see if he was under the influence, to which he agreed.
Saltkill exited the vehicle, at which point he was stumbling, trying to gain his balance. Saltkill used the vehicle to prop himself up as he traveled to the rear of the vehicle and had difficulty standing; therefore Ogle had him lean against his vehicle while Officer Gunnels administered the PBT.
Saltkill blew a fail in the portable breath test.
He then agreed to perform the standardized field sobriety test. Ogle found that Saltkill had a lack of smooth pursuit in both eyes and that he had distinct and sustained nystagmus at maximum deviation and a nystagmus prior to 45 degrees in both of his eyes.
Officer Ogle did not administer any other field sobriety test other than horizontal gaze nystagmus due to the fear of Saltkill being harmed. His inability to remain standing without stumbling was deemed a danger to his health.
Saltkill was arrested for driving under the influence and transported him to Cumberland County Jail.
