KROGER TO PAY $17 MILLION SETTLEMENT OVER PRESCRIPTION OVERCHARGING ALLEGATIONS
Grocery chain Kroger has agreed to a $17 million settlement following a 2021 class-action lawsuit accusing the company of overcharging customers for prescriptions by misreporting its “usual and customary” drug prices.

Who is Eligible: Any U.S. customer who filled prescriptions at a Kroger pharmacy between December 9, 2018, and August 23, 2026, and used insurance to cover all or part of the cost.

The Allegations: Plaintiffs claimed Kroger failed to offer insured customers the lower prices provided to members of its “Rx Savings Club.”
- Company Response: Kroger denied any wrongdoing, maintaining that its discount club pricing did not reflect standard rates, but ultimately agreed to the settlement.
Claims must be submitted online, by phone, or by mail by December 21. Customers may need to provide proof of their affected prescription purchases. Compensation amounts will vary based on how much was paid during the eligible period, with funds distributed via check, direct deposit, or apps like PayPal and Venmo.
The settlement is pending a judge’s approval scheduled for January 2027, and potential appeals could extend the resolution timeline.
