GOV. LEE SIGNS LAW GUARANTEEING ACCESS TO BIRTH CONTROL AND FERTILITY TREATMENTS
On April 24, 2025, Tennessee Governor Bill Lee signed HB 533, the “Fertility Treatment and Contraceptive Protection Act,” into law, ensuring Tennesseans’ access to birth control and fertility treatments, including emergency contraceptives, sterilization, and in vitro fertilization (IVF). The bill, introduced by Republican lawmakers Sen. Becky Duncan-Massey and Rep. Iris Rudder, passed the House 54-37 on April 10. It adds legal definitions for “contraception” and “fertility treatment” to the state code and protects the rights of individuals and healthcare providers to engage in these activities.
Despite support from Planned Parenthood and all 24 House Democrats, 11 Republican lawmakers, including Kingston’s Monty Fritts, urged Lee to veto the bill in a letter dated April 16, arguing it could undermine Tennessee’s pro-life stance. They expressed concerns about the destruction of unused embryos in IVF and selective abortions in cases of multiple pregnancies, calling the bill a potential “Trojan horse” for pro-choice activists. Lee, who has never issued a veto in seven years, signed the bill, disregarding the objections.
