TVA MAY CONTINUE CONSTRUCTION ON ROANE COUNTY GAS PLANT PENDING APPEAL
By Dudley Evans –
Construction on the Tennessee Valley Authority’s (TVA) multi-billion-dollar natural gas facility in Roane County will proceed while a federal lawsuit continues through the appeals process.
The Sixth U.S. Circuit Court of Appeals issued a decision on October 16 temporarily suspending a lower court order that had previously invalidated the utility’s environmental review and construction decision.
Key Details of the Ruling
-
Legal Standing: The appeals court concluded that the TVA is likely to succeed in its ongoing appeal and questioned whether the lower court selected the proper remedy.
-
The Opposition: Environmental organizations previously challenged the $2.5 billion project, arguing that the TVA failed to adequately consider alternatives and committed to natural gas before finalizing its environmental review.
-
Project Timeline: The Kingston gas plant is currently about halfway completed, with construction expected to continue into 2028.
While the immediate construction halt has been lifted, the underlying legal dispute remains unresolved.
