CROSSVILLE CITY COUNCIL APPROVES SETTLEMENT AMOUNT IN TOSHA CASE

The Crossville City Council has decided to settle in a case associated with a city employee’s filing of a complaint to the Tennessee Occupational Safety and Health Association. The council held a special-called meeting Tuesday afternoon. City Attorney Will Ridley continued to refuse to allow the media access to the actual complaint again citing attorney/client privilege. He also stated that the Attorney General cited the fact that the former employee needed to be protected. According to Ridley, the initial complaint was filed months ago and, after TOSHA investigated the incident, the city proposed an agreement but the employee would not sign a release form. City Officials received a notice from the attorney general on Nov. 1st setting a Nov. 6 deadline to respond, but the city requested and received an extension. Tuesday, Ridley offered the council a settlement proposal from the Attorney General’s Office that would not sue the city, and award a $7124 settlement to the employee for back-pay. The proposal also states that the city would not have to admit any guilt or wrong-doing in the case. The city’s insurance deductible in such a case is $5000, so that would be the total cost to the city. The city will also be required to post TOSHA notices in conspicuous places. Ridley said the former employee will be required to sign a release from the city and from the Attorney General, and that all documentation on the employee’s termination would be purged from the system and that no unfavorable recommendations be made toward her. Mayor Pro Tem JH Graham made the motion to accept the settlement with Council person Scott Shanks adding a second. The motion passed unanimously.
