DERRICK KANE FOISTER FACES MULTIPLE CHARGES IN CUMBERLAND COUNTY FOLLOWING A SERIOUS HIGHWAY ACCIDENT
A Cumberland County man appeared on the General Sessions Court criminal docket today, July 16, 2026, facing several charges—including vehicular assault and driving under the influence—stemming from a severe two-vehicle crash last summer.
Derrick Kane Foister was scheduled to appear in court regarding three separate criminal filings tied to the June 29, 2025 incident on Highway 127 at Industrial Boulevard.
According to official statements provided by Tennessee Highway Patrol (THP) Trooper Bobby Barker, Foister was traveling northbound when his vehicle broadsided another automobile, causing it to overturn. The collision resulted in serious bodily injuries to both the driver and passenger of the second vehicle. One passenger was ejected through the sunroof during the rollover and had to be transported to UT Medical Center for emergency treatment.

Vehicular Assault: Filed on February 26, 2026 (nine months later), charging Foister with felony vehicular assault due to the severe injuries sustained by the crash victims.

DUI – First Offense: Filed on July 2, 2025. Toxicology reports indicated Foister was impaired by a combination of substances at the time of the crash, including 1.8 mL of methamphetamine, 0.11 mL of amphetamine, and 47 ng/mL of alprazolam.

Implied Consent Violation: Filed on July 2, 2025, for refusing to voluntarily submit to a blood alcohol test following his arrest.
Trooper Barker noted in his report that Foister exhibited signs of severe impairment at the scene, displaying rapid, distracted speech consistent with stimulant use. After failing standardized field sobriety tests administered at a dry location with the assistance of THP Trooper Sparks, Foister was placed under arrest.
Foister is currently represented by attorney Lindsay Cameron Gross for his initial DUI and implied consent charges, and by the Public Defender’s Office for the vehicular assault charge. Proceedings remain ongoing in Cumberland County General Sessions Court.
