LAWSUIT FILED AGAINST TENNESSEE REGARDING RETAIL BUSINESS SALES TAX COLLECTION

A lawsuit has been filed naming Tennessee as the defendant in a case that requires all major online vendors to collect sales taxes on purchases made within the state. Currently, federal law says that sales taxes are to be collected by online businesses that have a physical presence in the state. Gov. Haslam’s new tax rule says that businesses that have sales of more than $500,000 per year in Tennessee, must charge taxes, no matter where they are located. The governor says that the state was sued last week after notices were sent out to such companies that the taxes must be collected. Haslam has long acknowledged that the move would likely result in litigation and says he hopes the U.S. Supreme Court will settle the matter.
