MAN SENTENCED IN DEATH OF SON IN CUMBERLAND COUNTY ATV ACCIDENT

An end came this morning in Cumberland County Criminal Court to a horrible mistake that led to the death of a child. In September 2017, officers and medical responders went to Jesse Loop where Joshua Miller and his son, 4-year-old Luke Miller, were involved in an ATV accident. Luke was flown to an area trauma center, where he passed away. An investigation showed Joshua Miller was under the influence at the time of the crash. Miller chose to have the case heard in criminal court and waived a grand jury to fast track the case. In court today, Miller pleaded no contest to negligent homicide and received five years on judicial diversion, which was agreed on by prosecutors, defense attorneys and the family. Miller had no previous trouble with the court and that made him eligible for judicial diversion. Miller must follow the terms of the diversion, including alcohol and drug treatment.
