TRIAL REGARDING WORKERS OF KINGSTON PLANT ASH SPILL COMING UP

The upcoming trial regarding the 2008 ash spill at the Kingston Fossil plant will be held in two phases because of the magnitude of the case. The first part will get underway October 16 and will involve evidence presented relating to whether defendants owed the plaintiffs a legal duty, if the defendants breached that duty and if that breach caused the plaintiffs injuries. After the spill took place, TVA hired Jacobs Engineering Group to oversee the cleanup. Dozens of people who worked, or had family members who worked on the project who passed away, are suing Jacobs. They claim continuous exposure to hazardous substances associated with fly ash caused them serious if not deadly health conditions.
