A federal judge has entered a consent judgment requiring a Celina, Tennessee pharmacist and two of his pharmacies to pay $450,000 to resolve civil claims under the Controlled Substances Act and the False Claims Act.

Thomas K. Weir, 65, along with Oakley Pharmacy, Inc. (doing business as Dale Hollow Pharmacy) and Xpress Pharmacy of Clay County LLC, reached the settlement following allegations that they knowingly dispensed controlled substances outside professional standards and falsely billed Medicare.

Key Details of the Judgment:

• Financial Penalties: The defendants must pay $450,000, with an initial payment of $70,000 due within seven days and the remaining $380,000 due within 45 days. These funds will directly credit the $1,419,974 in criminal restitution Weir owes to Medicare and TennCare.

• Controlled Substances Ban: Weir and the two pharmacies are barred from handling, dispensing, or possessing controlled substances through March 1, 2040, and cannot apply for a DEA registration until that time.

• Allegations: The 2019 civil complaint accused the pharmacies of ignoring red flags of drug diversion—such as high opioid dosages and long-distance travelers—and billing Medicare for medically unnecessary prescriptions.

The civil settlement follows Weir’s parallel criminal case, in which U.S. District Judge Aleta A. Trauger sentenced him to 24 months in federal prison on June 18, 2026, after he pleaded guilty to drug distribution conspiracy, health care fraud conspiracy, and Anti-Kickback Statute violations.
