CROSSVILLE POLICE TO HOLD SOBRIETY CHECKPOINTS

The Crossville Police Department, along with the Tennessee Highway Safety Office, will be conducting sobriety checkpoints February 4, 2018 starting at 6 p.m. and continuing to 10 p.m. The checkpoints will be held in the areas of Lantana Road, Peavine Road and U.S. Highway 127 in an effort to put an end to impaired driving. Police ask motorists to not approach a checkpoint with high-beams on and slow down when approaching a checkpoint. Officers will also be looking for properly restrained motorists and passengers. By publicizing checkpoints the police department is following the letter of the law. Back in 1990, a legal challenge came up in Michigan and the attempt was made to deem checkpoints unconstitutional. The United States Supreme Court ruled 6-3 that they were constitutional, but they mandated that checkpoints must be publicized ahead of time. If the police don’t publicize a checkpoint, it can be considered a detention without reasonable suspicion, and that violates fourth amendment rights.
