FAMILY OF MAKAYLA DYER SUES FAMILY OF 11-YEAR-OLD ACC– USED IN GIRL’S SHOOTING DEATH
The family of an 8-year-old girl who was shot and killed by an 11-year-old boy nearly a year ago in White Pine, say they are suing the boy’s family. MaKayla Dyer died from a gunshot wound after she would not fetch a puppy while allegedly playing with the boy out of a window of the Tiller home. According to court files, the boy, Benjamin, retrieved a 12 gauge shotgun and BB gun and told MaKayla and her friends that he had guns. Authorities say that the girl laughed and told the boy the guns were fake. Tiller then reportedly checked the gun’s ammo, cocked the gun and pulled the trigger, striking the 8-year-old girl in the chest. The $10 million wrongful death lawsuit says that the Tillers were negligent in allowing their son access to the gun. Benjamin has been remanded into state’s custody until he’s 19 years of age.
