SHAWN SMOOT TURNS IN HAND-WRITTEN REQUEST FOR NEW TRIAL
Convicted for less than a month in the shooting death of his former girlfriend, Shawn Smoot is requesting a new trial. Smoot was found guilty of the October 2011 murder of 23-year-old Brook Morris last month. Smoot turned in a hand-written motion on August 29th asking for the new trial or an acquittal. His argument is that insufficient evidence was introduced at the trial. Smoot claims that gunshot residue measured hours after the incident occurred proved negative results and that the court committed “prejudicial error” upon its’ denial to suppress hearsay evidence.
