JERRY KERLEY, WILLIAM HARWELL OPT FOR JUDICIAL DIVERSION IN SIGN THEFT CASE

City of Crossville City Water Works Director Jerry Kerley and Crossville Memorial Airport employee William Harwell will recieve judicial diversion involving the charges they faced over the reported theft of a number of homemade signs from a yard on Mockingbird Drive back on September 30th.  Kerley and Harwell were originally expected to accept judicial diversion during on the initial trial date back on November 10th.  At that time Attorney Jimmy Smith asked for more time to prepare for a hearing and the trial date was rescheduled for today.

Judicial diversion basically allows the defendants trial to be put on an administrative hold for a period of time agreed to by the prosecutor and the defendants and will remain on a form of probation during that period.  After that time, if the defendants stay out of trouble, they can file a petition to have the charges expunged from their record.  They are not proven guilty or not guilty, but if they become involved in any other crime during the probation period, the prosecuter can proceed with prosecution of the charges as originally filed.
